Inspector blocks new home bid
PROTESTERS have hailed as a victory a Government inspector's decision to block the building of a three-bedroom house in a back garden.
For the property behind homes in Tavistock Avenue, St Albans, would have had its access along a narrow lane which is at the heart of a complaint to the Local Government Ombudsman.
Residents claim that the proposed new house in Leaf Way would only be accessible by a private route.
In his report, the inspector, Mr R.W. Moon, noted the dispute over the road, which is only four metres wide and inadequate for two vehicles to pass.
He said that although neither the highways authority nor St Albans District Council had raised any objection to the principle of more development in Leaf Way, the increase in traffic in the lane added weight to his decision to dismiss the appeal.
Mr Moon ruled that the proposed house would be harmful to the living conditions of people in nearby homes and would be over-bearing in size and scale.
Alternative plans for a two-bedroom bungalow on the same site were rejected by the district council earlier this month.
Residents in the area have complained to the Ombudsman over what they claim are planning infringements at other developments accessed from Leaf Way.
Resident Iain Grant said: "This decision vindicates those of us who have been saying for some time that Leaf Way cannot even accommodate the traffic from the homes that have been built there already.
